This End-User License Agreement (the “Agreement”) governs the use of Polarisor Proof. It is made between Orest Palamar, a sole proprietor in Ukraine (the “Licensor”), and the person who installs or uses Polarisor Proof (the “End User”). The End User’s purchase through Creem is made under a separate contract between the End User and Armitage Labs OÜ, acting as Creem. This Agreement does not create an additional purchase contract or any obligation of the End User to pay the Licensor separately. Annex A, Refund Policy, version 1.1, forms part of this Agreement.
1. Parties and acceptance
The Licensor develops Polarisor Proof and makes it available under the Polarisor brand. The Licensor’s full business details and contact information are published in the Legal Notice. Contact email: support@polarisor.com.
The End User accepts this Agreement by expressly selecting its acceptance box at checkout or by expressly accepting it in the Polarisor Proof installer. For a free trial that does not pass through checkout, acceptance takes place in the installer. Visiting the website does not by itself mean accepting this Agreement. An End User who has not accepted the applicable license terms may not install or use the software.
If the End User has already accepted this version at checkout, displaying it or accepting the same version again in the installer does not create another purchase, another license fee or a different set of terms. A later version can apply to an existing license only in accordance with Section 15; merely displaying that version in an installer does not amend an earlier agreement.
The website edition and the installer/application edition of the same version contain the same license conditions and Annex A. Their presentation and link formatting may differ. The date above identifies the text, not the date of the End User’s purchase or acceptance.
2. The product
Polarisor Proof is a Windows desktop application for post-trade review. It requires Windows 10 or Windows 11, 64-bit. It helps the End User assess the End User’s own trading discipline against the rules the End User sets. The results shown by the application are calculated from data the End User enters or imports and depend on its accuracy.
It does not provide investment or financial advice, trading signals, trading strategies or market forecasts. It does not connect to brokers or exchanges, place or execute orders, or hold or manage funds. Every decision the End User makes in the markets remains the End User’s own decision. No trading outcome or profitability is promised.
3. License grant
When the End User’s order is complete and the license has been issued, the Licensor grants the End User a personal, non-exclusive, perpetual license to install and use Polarisor Proof for reviewing the End User’s own trading, subject to this Agreement. The license is valid worldwide, subject to applicable law, including export controls and sanctions. Except to the extent that mandatory law provides otherwise, the license is non-transferable.
This is a one-time purchase, with no subscription or recurring license fee. Updates, when provided under this license, are covered by the same license conditions. This Agreement does not promise new features or a particular development roadmap. Nothing in it limits any obligation under applicable mandatory law to provide updates, including security updates, necessary to maintain conformity of the software.
The paid license has no fixed expiry date. It remains subject to the activation requirements in Section 4 and the lawful termination provisions in Section 13. This Agreement does not authorize the cancellation of an otherwise valid perpetual license merely because the Licensor permanently discontinues its validation infrastructure. Mandatory rights and remedies in that situation remain unaffected.
4. Activations
A license covers up to three simultaneously active installations. These are reusable activation slots, not a lifetime limit of three installations. When an activation ends, its slot becomes available. If all three slots are occupied, activating another installation requires choosing an existing installation to replace.
A new installation is activated online with the End User’s license key. The first installation does not require a separate email confirmation. Each subsequent activation, including a reinstallation, must be confirmed through the email address associated with the license. If all three slots are occupied, the same email process is used to select the installation to replace.
An activated paid copy periodically needs internet access to confirm that the license remains valid. If validity cannot be confirmed for an extended period, the application enters read-only mode: existing records can still be viewed, but records cannot be added or edited until a valid license is successfully confirmed again. Entering read-only mode does not itself delete the End User’s locally stored records. Temporary inability to validate a license is not, by itself, termination of that license.
This Agreement does not publish the internal validation intervals or security thresholds. It does not promise that records can be edited indefinitely without a successful license check. The operation described above must be disclosed before purchase; mandatory rights relating to the disclosed and reasonably expected functionality remain unaffected.
The End User must not share a license key with other people or publish it, except to the extent necessary for a transfer protected by Section 6. For activation or access problems, the End User may contact support@polarisor.com.
Activation is not yet available.
5. Free trial
After accepting this Agreement in the installer, the End User may install and use Polarisor Proof free of charge for evaluation, with full functionality for 14 days from the first application launch. The period starts on first launch, not merely on installation. No purchase through Creem or separate trial registration is required.
When the trial ends, the application remains available in read-only mode: existing data can be viewed, but records cannot be added or edited until a paid license is activated. No automatic purchase or payment arises when the trial ends. Circumventing the trial period is not permitted.
6. Restrictions
Except to the extent permitted by applicable mandatory law, the End User may not copy or redistribute the software other than as needed for the End User’s lawful use and necessary backups; sell, rent, sublicense or share the End User’s license; reverse engineer, decompile or modify the software; circumvent its trial, activation or licensing mechanisms; or use it for unlawful purposes.
These restrictions do not exclude any non-waivable right of a lawful user of a computer program, including necessary backup copying, observing, studying or testing the program, or decompilation for interoperability where the conditions of applicable law are met.
Nothing in Sections 3, 4, 6 or 13 restricts a right to transfer a lawfully acquired copy of the software and its associated right of use where applicable mandatory law does not permit that right to be excluded. This is not permission to retain or share additional usable copies beyond those allowed by that law and this Agreement.
7. Intellectual property
Rights in Polarisor Proof and the Polarisor name and marks belong to the Licensor or their respective lawful owners. They are protected to the extent provided by applicable intellectual-property law. This Agreement grants only the rights of use it describes; ownership of the software or its intellectual property is not transferred to the End User.
Rights in the data the End User enters into the application remain with the End User or their respective lawful owners. This Agreement does not assign those rights to the Licensor.
8. Support
Product support is provided by email at support@polarisor.com. What to include in a request is described on the Support page.
No fixed commercial response time or service-level agreement is promised. This does not displace any mandatory deadline or obligation to deal with a statutory claim or bring the software into conformity. Requests under Annex A remain subject to its provisions.
9. Purchase through Creem
The End User purchases Polarisor Proof from Armitage Labs OÜ, acting as Creem, the Merchant of Record and reseller. Creem processes payment, issues the buyer’s invoice and handles applicable VAT, sales tax and other indirect taxes on that transaction. The purchase is governed by the Creem Buyer Terms. This Agreement does not amend that separate purchase contract or create an additional charge payable directly to the Licensor.
Delivery of the license key and technical support are handled by the Licensor under its arrangements with Creem. That allocation does not exclude or limit any mandatory rights the End User has against Creem as seller or against the Licensor. If product-specific provisions conflict with the Creem Buyer Terms, those Buyer Terms take precedence to the extent required by the contractual arrangement, always subject to mandatory law.
10. Refunds
Annex A, Refund Policy, version 1.1, is reproduced below and forms part of this Agreement. The same policy is also published as a separate page: Refund Policy. The incorporated version is the one accompanying the Agreement accepted by the End User; a later website update does not silently replace it.
Accepting this Agreement is not, by itself, express consent to immediate supply coupled with an acknowledgement of losing a statutory withdrawal right. Any such consent and acknowledgement must be obtained separately where required by law, as explained in Annex A.
11. Warranty disclaimer
Subject to the mandatory rights preserved in Section 12, the software is provided “as is” and “as available”, without additional express or implied warranties to the extent the law permits them to be disclaimed. No additional warranty is given that the software will be completely error-free or uninterrupted, that its calculations will fit an undisclosed purpose or that it will produce a trading result.
This disclaimer does not qualify away the functionality or characteristics expressly agreed at purchase or the statutory conformity obligations that apply.
12. Limitation of liability
To the extent permitted by applicable law, the Licensor is not liable for indirect or consequential losses arising from the use of or inability to use the software. This may include trading losses, lost profits or lost data only to the extent that they fall within a category of loss that may lawfully be excluded. It does not mean that every trading loss or loss of data is necessarily indirect or legally excludable. Subject to the exceptions below, the Licensor’s total liability for claims relating to a license is limited to the amount paid for that license.
The disclaimers and liability limits in Sections 11 and 12 do not restrict any mandatory rights or remedies concerning supply, conformity or necessary updates. They do not exclude or limit liability for intentional breach of obligations, or any other liability that applicable law does not permit to be excluded or limited.
13. Termination and revocation
The Licensor may terminate full-function use for a material breach of this Agreement, including unlawful sharing of keys or circumvention of licensing, only to the extent and by the procedure permitted by applicable law. Any notice or opportunity to remedy a breach required by that law must be respected. A transfer protected by Section 6 is not a breach.
If the underlying purchase is lawfully terminated, including following a confirmed full refund or a completed full chargeback that ends that purchase, the corresponding paid-use license ends. A bank dispute or a payment reversal does not by itself determine all contractual rights: revocation must have a lawful basis. Merely opening a dispute does not revoke the license. A partial refund or partial chargeback does not by itself revoke it. A statutory price reduction, as distinct from termination of the purchase, does not by itself end the license, even if the reduction equals the price paid.
Where a license is lawfully revoked, the application receives that state at its next successful license check. Full-function use ends. The Licensor separately permits the available read-only mode without charge so that the End User can view existing records; this does not continue the terminated paid-use right. Revocation does not itself delete those locally stored records. If a revocation was erroneous, the End User may contact support@polarisor.com for review and restoration where the right of use remains valid.
14. Privacy
Personal-data handling on the website, in purchases, support and the application is described in the Privacy Policy. It is a separate information notice and does not form part of this Agreement as a consent to processing. Any consent that is legally required for a particular processing operation must be obtained separately.
The fact that internet access is needed for activation and validation does not turn acceptance of this Agreement into consent to unrelated analytics or marketing.
15. Versions and changes
Each version of this Agreement has a number and text date. The website and installer/application editions bearing the same version are different presentations of the same terms. Previous accepted versions, including their refund annexes, are retained and are available on request at support@polarisor.com. The current website text is published at polarisor.com/terms.
The version accepted by the End User continues to govern the End User’s existing license. Publishing or displaying a later version does not by itself amend that agreement or reduce acquired rights. Any change to an existing agreement must be validly agreed or otherwise permitted by applicable law, subject to mandatory consumer protections. Keeping copies available on request does not replace any mandatory obligation to provide a contract confirmation on a durable medium.
The English text is the reference version. Translations may be provided. The English text prevails over a translation only to the extent permitted by mandatory law; this does not override mandatory language requirements, consumer-friendly interpretation rules or non-waivable rights.
16. Governing law and jurisdiction
This Agreement and the contractual relationship between the End User and the Licensor are governed by the laws of Ukraine.
If the End User is a consumer, this choice does not deprive the End User of the protection afforded by mandatory provisions of the law that would apply without that choice, including, where applicable, the law of the country of the End User’s habitual residence.
Disputes between the End User and the Licensor may be brought before the courts having jurisdiction under applicable law. Nothing in this Agreement restricts any mandatory right the End User has as a consumer to bring proceedings before the courts of the End User’s domicile, or overrides mandatory rules governing proceedings brought against the End User.
This section concerns only the relationship between the End User and the Licensor. The End User’s purchase contract with Armitage Labs OÜ, acting as Creem, remains subject to the applicable Creem Buyer Terms and mandatory law.

Annex A. Refund Policy
Version 1.1 | Text dated 4 October 2026 | Included in EULA version 1.1
A.1. Scope and mandatory rights
This policy concerns purchases of Polarisor Proof through Creem. It does not replace the Creem Buyer Terms or restrict any mandatory consumer rights. Creem remains the seller and processes refunds; the Licensor handles product-related assistance and normally assesses requests under its arrangements with Creem.
The 14-day free trial lets the End User evaluate the software before purchase, but it does not replace any statutory withdrawal period or remedy for failure to supply or lack of conformity. There is no additional unconditional money-back guarantee under this policy. Outside mandatory rights, requests concerning duplicate or accidental purchases may be considered individually; consideration alone is not a promise of a refund.
A.2. EU right of withdrawal
Where EU consumer withdrawal rules apply to the End User’s purchase, the general period for withdrawing from a distance contract for digital content not supplied on a tangible medium is 14 days from conclusion of the contract, without giving a reason, subject to statutory exceptions and any legally applicable extension of that period.
For paid digital content, the right may be lost after supply has begun only if the legal conditions are met: the End User gave prior express consent to begin supply during the withdrawal period, acknowledged that this would cause the End User to lose that right, and received the required contract confirmation on a durable medium. Agreeing to an EULA, using a trial or merely downloading the software does not replace those requirements. If the requirements for loss are not met, the applicable withdrawal right remains.
The End User may notify Creem using an unequivocal withdrawal statement, its available withdrawal channels or the optional form in A.7. The End User may also contact support@polarisor.com for assistance; contacting the Licensor first is not a condition for exercising rights against Creem. A timely statutory withdrawal does not depend on giving a reason, proving a technical defect or completing troubleshooting. These rules do not displace any mandatory rights that apply to consumers outside the EU.
A.3. Failure to supply or lack of conformity
Where the software is not supplied or does not conform to the contract, the remedies and conditions provided by applicable law apply. Depending on the circumstances, they may include obtaining supply, bringing the software into conformity without charge, a proportionate price reduction or termination with reimbursement.
Support may be given a reasonable opportunity to bring the software into conformity where the law provides for that remedy first. This is not a requirement to accept repeated failed attempts or to postpone an immediate remedy where the law entitles the End User to it. Rights concerning lack of conformity are not automatically limited to 14 days after purchase or to a defect that makes the software entirely unusable.
A.4. How to make a request
The End User should email support@polarisor.com, preferably from the address used at checkout, and provide the Creem order reference or other information that reasonably identifies the purchase. If the End User no longer has access to that email address or the reference, the End User should say so, so that another proportionate means of identifying the purchase can be considered. Payment-card security codes and unnecessary financial records should not be sent.
For a defect claim or a discretionary request, the End User should briefly describe the problem. No reason is required for a statutory withdrawal that may be exercised without giving one. The Licensor’s support process does not exclude lawful direct requests to Creem, a payment provider, a competent authority or a court.
A.5. Refund processing and time limits
Creem processes the refund under the applicable Buyer Terms and law. For statutory refunds covered by the applicable EU withdrawal rules, reimbursement is due without undue delay and no later than 14 days after the seller is informed of the decision to withdraw. Where applicable EU digital-content rules or the corresponding Ukrainian rules require reimbursement following a price reduction or termination for failure to supply or lack of conformity, the applicable period is likewise no later than 14 days from receipt of the relevant notice or claim. These periods are not restarted by an internal “approval” date. Any other mandatory rule that applies is preserved.
Statutory reimbursement is made using the original means of payment unless the End User expressly agrees otherwise, without a fee charged to the End User for that reimbursement. Payment-provider settlement time must not be used to postpone the seller’s legal obligation to make the refund. Creem may also issue refunds where required by law or its applicable payment procedures.
A.6. Effect on the license
A lawfully terminated purchase ends the corresponding paid-use right as set out in Section 13 of the EULA. A partial refund, partial chargeback or statutory price reduction does not by itself terminate that right. Following lawful revocation, the application remains available in read-only mode for existing locally stored records; revocation does not itself delete them.
This version of the policy is the annex accepted with the corresponding EULA. A later change to the website page (Refund Policy) does not by itself replace it for an existing agreement.
A.7. Optional withdrawal form
The End User may use this form only to withdraw where the applicable withdrawal right remains. An unequivocal statement in another form is also permitted; this template is not the only route. The text of the form is written in the first person because it is the End User’s own statement.
